By accessing and using ForkFleet Local Delivery ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

Service Description

ForkFleet provides a food delivery platform that connects customers with local restaurants. We facilitate the ordering and delivery of food but are not the seller of the food items.

User Accounts and Responsibilities

• All activities that occur under your account
• Notifying us of any unauthorized use

Eligibility

You must be at least 16 years old to use our Service. By using our Service, you represent that you meet this age requirement.

Orders and Payments

Placing Orders

When you place an order:

• You make an offer to purchase food items
• Orders are subject to acceptance by the restaurant
• We reserve the right to refuse or cancel orders
• Prices are subject to change without notice

Payment

Payment must be made at the time of order. We accept various payment methods as displayed on our platform. All payments are processed securely through third-party payment processors.

Delivery Fees

Delivery fees are calculated based on distance, demand, and other factors. The total cost, including all fees, will be displayed before you confirm your order.

Delivery Times

Estimated delivery times are approximate and may vary based on restaurant preparation time, traffic, weather, and other factors. We strive to deliver within the estimated timeframe but cannot guarantee exact delivery times.

Delivery Address

You must provide a complete and accurate delivery address. We are not responsible for deliveries to incorrect addresses provided by you.

Failed Deliveries

If a delivery cannot be completed due to incorrect information, unavailability, or refusal to accept, you may still be charged for the order.

Cancellations and Refunds

Order Cancellation

Orders can be cancelled within a limited time after placement. Once the restaurant begins preparing your order, cancellation may not be possible.

Refunds

Refunds are issued at our discretion and may be provided for:

• Cancelled orders (before preparation begins)
• Incorrect or missing items
• Food quality issues (with appropriate evidence)
• Significant delivery delays caused by us

Food Quality and Safety

While we partner with reputable restaurants, we are not responsible for the quality, safety, or preparation of food items. Any concerns about food quality should be reported immediately.

Allergies and Dietary Restrictions

You are responsible for communicating any allergies or dietary restrictions when ordering. We cannot guarantee that restaurant partners accommodate all dietary needs.

Intellectual Property

All content on our Service, including text, graphics, logos, and images, is the property of ForkFleet or our licensors and is protected by copyright and trademark laws.

Prohibited Activities

You may not:

• Use the Service for any illegal purpose
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Impersonate any person or entity
• Harass, abuse, or harm our staff or delivery personnel

Limitation of Liability

To the maximum extent permitted by law, ForkFleet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Indemnification

You agree to indemnify and hold ForkFleet harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Lviv, Ukraine.
